All account services must be paid for at time of request for services.  A $20 one-time setup fee is required for all new hosting accounts.

All you have to do is choose the services you desire and then pay for them via our secure server. We accept MasterCard/Visa, PayPal, wire transfer, money orders, business or personal checks.

 Services will not begin until payment has been made
 or checks have cleared the bank.

International Payments: 

Please make payments in United States Dollars (USD) by Visa/ MasterCard, or wire transfer.

Monthly Statements:

If your hosting account is Not set up for automatic credit card billing, monthly statements are emailed to you 14 days prior to the day your account is due.  Payment is due within 7 days of receipt of the billing invoice.  Their are no contract periods.  For each successive period, your contract is automatically renewed unless we are notified otherwise.  For Account Cancellation information, see below.

Late Payments:

All hosting accounts are billed according to the day of the month they were first activated.  Terms are set at Net 7 or net amount due within 7 days of receipt of invoice. Balances not paid at the time of the monthly renewal of the account will be considered past due. Accounts that are past due may be disabled or cancelled solely at our discretion.  Accounts that are over 30 days past due will be charged interest at the rate of 1.5% per month.

Billing Discrepancy:

Reconciliation will still be allowed for up to 60 days after the original date of the invoice in question. In other words, you do not forfeit the right to question an invoice once it has been paid. If payment is received on time, and afterwards (within the 60-day time frame) you discover an error on our part please notify us of this error, it can then be corrected. Please allow us sufficient time (before the expiration of the 60 days) to review the account(s) in question. Please remember that if you are responsible for the error (i.e. typo in domain name), you must contact our Billing Department immediately (within 7 days of the error) to receive a credit for the error.

Account Cancellation:

If you wish to cancel your hosting account, please send an email to our Billing Department  Provide your name, address, telephone number and domain name.  We require 14 days advance notice to cancel an account.  Your account can only be cancelled in accordance with your monthly billing cycle.  For example, if your account renews on the 15th of the month, it will be cancelled at the end of the next billing cycle on the 15th of the month, after you have given the required notice.

The following acceptable use guidelines should be followed by all those who use our hosting services and those who resell our services need to make sure that all those they sell services to follow these rules or both their account and all sub accounts are subject to termination.

Content:

All services may be used for lawful purposes only. Transmission, storage, or presentation of any information, data or material in violation of any United States Federal, State or City law is prohibited. This includes, but is not limited to: copyrighted material, material we judge to be threatening, obscene, demeaning to others, or material protected by trade secret and other statute. The subscriber agrees to indemnify and hold us harmless from any claims resulting from the use of the service which damages the subscriber or any other party. In addition any site selling or promoting Bulk email services is not allowed.

Note: Pornography and sex-related merchandising are prohibited on all servers. This includes sites that may infer sexual content, or link to adult content elsewhere. This is also true for sites that promote any illegal activity or content that may be damaging to our servers or any other server on the internet. Links to such materials are also prohibited. 

Examples of non-acceptable content or links: 

We will be the sole arbiter as to what constitutes a violation of this provision. 

Traffic Guidelines:

Due to the unique resource characteristics and traffic patterns associated withcertain types of sites, the following are limited to 3 gigs of free traffic: 

CGI Scripts:

Each account comes with its own cgi-bin. You are free to use any CGI scripts you wish, however we reserve the right to disable any CGI script that effects normal server operation without prior warning. 

Background Running Programs:

Background daemons in general are prohibited, we will consider requests on a one on one basis. If allowed extra charges will be assessed based on resources on system maintenance needed. 

IRC:

We currently do not allow IRC or IRC bots to be operated on our servers. 

As such, any violation will result in immediate deactivation of services without refund. 

Server Abuse:

Any attempts to undermine or cause harm to a server is strictly prohibited.

Spam:

Sending unsolicited e-mail, or "spam" through our mail servers or is strictly prohibited.  Spamming is the sending of unsolicited e-mail, regardless of size or volume, to persons the sender does not know or have prior consent to send the message to. Using fictitious e-mail addresses @practicalwebhost.com or any domain name hosted with PracticalWebhost is strictly forbidden. Spamming also includes sending unsolicited advertisements to numerous email addresses or newsgroups generating a significantly higher volume of outgoing email than a normal user.  If you are found to have spammed, then we will immediately, without warning, disable your domain.  We reserve the right to refuse or cancel service to known spammers. Lastly, we reserve the right to determine what violates this policy. Report spam or abuse issues to abuse@practicalwebhost.com.

Indemnification:

Customer agrees that it shall defend, indemnify, save and hold PracticalWebhost and it's associates harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney's fees asserted against PracticalWebhost, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, it's agents, employees or assigns. Customer agrees to defend, indemnify and hold harmless PracticalWebhost against liabilities arising out of; (1) any injury to person or property caused by any products sold or otherwise distributed in connection with PracticalWebhost's servers; (2) any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party and (3) copyright infringement. 

Refusal of Service:

We reserve the right to refuse or cancel service at our sole discretion.

PracticalWebhost will not be responsible for any damages your business may suffer. PracticalWebhost makes no warranties of any kind, expressed or implied for services we provide. PracticalWebhost disclaims any warranty or merchantability or fitness for a particular purpose. This includes loss of data resulting from delays, and any and all service interruptions caused by PracticalWebhost and its employees. PracticalWebhost reserves the right to change or update policies without notice. 

If any terms or conditions are failed to be followed it may result in account deactivation. 

Account Upgrades:

You may upgrade your services at any time. Email us if you are interested in upgrading at sales@PracticalWebhost.com. When you upgrade your services, this is a permanent upgrade unless you email us and let us know that you only want that particular upgrade for that month. We do not allow you to go back and forth between hosing accounts. 

Uses of Linked Sites:

In many cases, we link to websites to provide you with what we believe are superior services. Sometimes the websites we link to provide our clients with a service or product for a reduced price. Sometimes we just link to websites that pay to advertise on our site. In all cases, we are not responsible for their services or products and if you find yourself with a problem with anyone else's website, please submit any and all complaints to the webmasters of the site you are having the problem with. For complete details of a product or service always check with the site providing the service. They can give you the most up to date information and prices. If you find we have listed a website's services or prices in error, just see our feedback form and let us know, we will promptly correct the mistake. If there is a problem with fraudulent information, feel free to let us know here and if we the problem is more than just a simple mistake, we will discontinue our association with that company or site.
